First Bite Club — Privacy Policy

Contemplation, Inc. DBA First Bite Club, 4210 Via Marina, Ste 10, Marina Del Rey, CA 90292 ("First Bite Club," "we," "us") operates a restaurant rewards service (the "Service"). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. It applies to the Service, including the web app you reach by scanning a QR code at a participating restaurant, and to mail-in entries.

By using the Service, you agree to this Privacy Policy and our Terms & Conditions.

Age minimum confirmed: 21. This document's Section 7 has been updated to match the Terms & Conditions.

1. Information We Collect

Information you provide:

Email address — required to receive and redeem rewards and to sign in.
Name and mailing address — only if you enter by mail using the free alternative method of entry described in our Terms & Conditions.
Ratings and feedback — if you choose to rate a restaurant visit or submit written feedback, we collect your rating, your feedback, and any contact information you choose to include with it.

Information collected automatically:

Device token — a random identifier stored in your browser's local storage. We use it to detect duplicate accounts and prevent abuse of the rewards program. It is not used to track you across other websites or apps.
Usage and log data — pages viewed, entries made, rewards issued and redeemed, timestamps, IP address, and browser type, collected when you use the Service.

We do not collect payment information. Your payment for your meal happens directly with the restaurant and never passes through First Bite Club. We do not knowingly collect precise geolocation data.

2. How We Use Personal Information

We use personal information to:

Operate the rewards program: create your account, verify your email via sign-in links, run entries, issue rewards, and record redemptions;
Send transactional emails (sign-in links, reward issuance, redemption confirmations);
Send program emails about your rewards, including reminders before a reward expires — these include an unsubscribe link;
Detect and prevent fraud and abuse, including duplicate accounts;
Share your rating and feedback with the participating restaurant you rated, so it can review and, if you provided feedback information, follow up with you;
Comply with legal obligations and enforce our Terms & Conditions;
Maintain and improve the Service.

We do not use your personal information for cross-context behavioral advertising, and we do not sell your personal information.

3. How We Share Personal Information

Participating restaurants. The restaurant where you entered receives information needed to operate the program at its location: reward issuance and redemption records associated with your account, and any rating or feedback you submitted about that restaurant (including contact information you chose to include with feedback). Restaurants may use feedback contact information to follow up with you about your experience.
Service providers. We use third-party providers for hosting, database and authentication infrastructure, and email delivery. They process personal information only on our instructions to provide those services.
Legal and safety. We may disclose information if required by law, legal process, or to protect the rights, safety, or property of First Bite Club, our users, or others.
Business transfers. If First Bite Club is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to this Policy.

We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under California law. If that ever changes, we will update this Policy and provide the required opt-out mechanisms first.

4. Cookies, Local Storage, and Do Not Track

The Service uses local storage for session authentication and for the device token described above. We do not use third-party advertising cookies or trackers. Because we do not track users across third-party websites or online services over time, the Service does not respond differently to browser "Do Not Track" signals — there is no cross-site tracking to disable.

5. Retention

We retain personal information for as long as your account is active and as needed to operate the program, resolve disputes, prevent fraud, and comply with legal obligations. Redemption records may be retained after reward expiration for audit and fraud-prevention purposes. Mail-in entry letters are retained for twelve (12) months after processing and then destroyed. [Suggested default — a reasonable, commonly-used window for fraud/audit purposes; confirm this fits your actual operational needs.] If you close your account, we delete or de-identify your personal information within thirty (30) days, except where retention is required by law or for fraud prevention. 6. Your Privacy Rights

California residents. The California Consumer Privacy Act (CCPA, as amended by the CPRA) applies to businesses meeting certain thresholds. Whether or not First Bite Club currently meets those thresholds, we voluntarily extend the following rights to all users, and we will honor them as required by law for California residents:

Right to know/access — request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom it was shared;
Right to delete — request deletion of your personal information, subject to legal exceptions (for example, fraud-prevention records);
Right to correct — request correction of inaccurate personal information;
Right to opt out of sale or sharing — we do not sell personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of today;
Right to non-discrimination — we will not deny you rewards, charge you different prices, or provide a different level of service because you exercised a privacy right.

To exercise any right, email support@firstbiteclubhouse.com or write to the address above with the subject "Privacy Request." We will verify your request using the email address associated with your account (we will send a confirmation link to that address) and respond within the timeframe required by law (generally 45 days for California requests, extendable once by 45 days with notice). You may use an authorized agent; we may require proof of the agent's authority and verification of your identity.

We do not use your personal information for automated decisions that produce legal or similarly significant effects. The random selection of your reward tier is a game mechanic within the program, not a profiling decision about you.

Other states. Residents of other states with comprehensive privacy laws may have similar rights; we will honor verified requests as those laws require. Contact us at support@firstbiteclubhouse.com.

7. Children

The Service is intended for adults age 21 and older. You must be at least 21 years old to participate. We do not knowingly collect personal information from anyone under 21, and we do not knowingly collect information from children under 13 under any circumstances. If we learn we have collected personal information from a minor, we will delete it. Contact support@firstbiteclubhouse.com if you believe a minor has provided us personal information.

8. Security

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information we hold, including access controls, encrypted transport, and server-side-only handling of reward and redemption records. No system is perfectly secure; please use a personal email account you control and keep access to it secure, since your email is the key to your account.

9. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be announced by email or by prominent notice in the Service before they take effect. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Policy.
